When I sent the formal estimate I included photos of the project we had discussed for the color reference and photos of seamless overlays so the client could get an overall feel for what those look like completed. The estimate was accepted by the client and we were asked to schedule the work.
The client was on site every day and did not express displeasure with any part of the process. The client complimented the stain colors and let us know that they would not be home on the final day but we could go ahead and seal and finish the project.
Once the project was completed, the client reached out with a few questions. There was some outgassing throughout the project. Outgassing is an issue with the existing slab. It allows air from the existing slab to travel up through the overlay and causes a bubble which pops, leaving a little ring in the stain. This is a normal occurrence in concrete and is outlined in the contract the client signed.
The client also asked about the texture and “pitting” that was in the overlay. I reminded the client that an overlay is done by hand and variations are normal and to be expected. I sent the client photos of other seamless, non patterned overlays for reference before beginning the project and it is outlined in the estimate and the contract that overlays will have varying textures throughout the project.
The client paid the final invoice after receiving my email with the answers to the questions asked. This was on December 13, 2020.
On Christmas Eve I received an email from the client asking for a meeting to discuss the project. The meeting was scheduled and we attended but the client did not. The client sent their spouse, who is not the contract holder to meet with us. The client’s spouse expressed dissatisfaction with the same issues, and we explained again these are normal variations within an overlay. There was an area around the lanai that the client’s spouse pointed out that they were dissatisfied with because of some pooling of the stain. There was also some overspray of the stain on the metal bottom rail of the lanai. We apologized for the overspray and offered to do what we could to remedy that situation. We explained to the client’s spouse that we do take precautions to protect areas adjacent to the project but with a liquid coating, overspray does happen at times. We also offered to install a 6” solid colored border around the project perimeter to remove the stain pooling area from view. The client’s spouse seemed open to that suggestion and agreed for us to send the client a color chart to choose the band color. I sent a follow up email to the client after the meeting to recap the suggestions.
The client responded that they did not want us to install a border. The client stated that the photos I had shown and sent for color verification is what was promised. This is incorrect. I was very clear during the in person meeting and the notation on the estimate that was approved by the client that those photos were for color reference only. Along with the color reference photos, I sent the client photos of completed overlay, stain and seal projects for reference prior to beginning the project.
The contract that the client signed covered all the issues that are the stated complaints, with the exception of the overspray.
The client did receive what was agreed upon verbally and in the contract. I am disheartened that the client is dissatisfied with the outcome of the project, however, we fulfilled our obligations according to the verbal discussions and the signed contract.
The client was offered arbitration to settle the disagreement, per the contract. She refused. I am truly sorry that the client does not like the final product, but she was well informed of the uniqueness of a concrete overlay, stain and seal.
We are not willing to redo the project for the client because many of the "issues" she is complaining about will happen again. Outgassing (or "circles") are from the existing slab allowing air to pass through the overlay. Inconsistent appearance is the nature of stain - it is variation. There was no stain spilled on the project. Lower concrete areas of the the project may hold onto stain longer before drying, which concentrates it more in that area.
