No federal agency has the authority to issue 'official' rulings legally binding on civilians or civilian groups concerning the flag.
Criminal penalties for certain acts of desecration to the flag were contained in Title 18 of the United States Code prior to 1989. The Supreme Court decision in Texas v. Johnson; June 21, 1989, held the statute unconstitutional. This statute was amended when the Flag Protection Act of 1989 (Oct. 28, 1989) imposed a fine and/or up to I year in prison for knowingly mutilating, defacing, physically defiling, maintaining on the floor or trampling upon any flag of the United States. The Flag Protection Act of 1989 was struck down by the Supreme Court decision, United States vs. Eichman, decided on June 11, 1990.

Remember then (at least in a civilian context) that a flag is just a symbol and "etiquette" merely a suggestion. Some of us revere the symbol and forget the principle and country for which it stands. Consequently, we foul our nests, pollute our air, our water, poison our food and hurt our fellow countrymen with toxic and economic hardships that flow naturally from these same actions. "Patriotism is the last refuge of a scoundrel," wrote Samuel Johnson and what I think that means is "when all else fails, wave a flag." On Independence Day we should try and remember that a free republic is one that embraces liberty and the right to express oneself strongly, freely and in different ways. Some of these different expressions may apply to the flag and while pledging and singing to "Old Glory" will cause many to feel proud of our freedom, country and military victory, it may cause others to feel jingoistic and even mildly fascist. Happy 4th and hang or not hang a flag to celebrate it!
