My roofer eat his word about the deductible. can I cancel contract

My roofer knocked my door and told me the roof was damaged by the hail. He asked me to sign a contract and said he will responsible for all the deductible ($6000). It is not written in the contract. In the contract, he wrote the money the insurance company estimated($25000). He told me it is just for the mortgage company to release the check issued by the insurance company, I trusted him. I gave him the upfront money ($9500), and he promised will start the work in 2 week(should be last friday). But he postponed to July 8. I called him to confirm the date and he told me it will start July 9 and I need to pay the deductible. Can I still cancel the contract? Thanks!

Thanks for your reply and it is a big lesson for me to learn. I think the roofer just want me to cancel the contractor and he can get the money (35% of the $25000) for free, IF I did not cancel, I am worry about the quality and the time he will start the project. Can he randomly change the start date? l found the contract is not initials at the first agreement YES. Can this cause the contract invalid?

The contract is nearly meaningless; it's who has the money and right now he does.

But if the contractor is invalid, how can he still hold the money? I also found he claimed him as BBB at the contract but not at that time. He just joined on May 9 and his website also not exist.

You are lucky he is even still in the same state, you MIGHT actually get a new roof, which must be pretty big for 25g's.

"But if the contractor is invalid, how can he still hold the money?"

Because he holds the money. It's very unlikely you're getting it back.

It's time to consult with an attorney. $9,500 is a lot to write off. I would seriously doubt that you'll get a lot of it back, but make the crook suffer as much as legally possible.

    zzldyk,

I think you and your roofer were trying to commit insurance fraud. You may have not know it, but your roofer knows.

After your insurance company finds out about this, they may cancel your insurance.

Sounds like a scam artist who preys on storm victims. There was a lot of that going on five years ago after a tornado devastated my area. You might want to contact your state Attorney General's office. Alternatively, you could call your local television news station's consumer protection (?) reporter; they love this kind of stuff!

OMG how scary! I hope you get a new roof or your money back.... If it makes you feel any better, I had a guy knock on my door too, claimed I had hail damage. State Farm sent someone and they agreed. My roof only cost 9k, and State Farm covered 7k... I did end up using the guy who knocked on my door and everything turned out fine... But I didn't give him any money upfront.
