the seat of the stool should be 12" below the top of the counter. which explains 29/41, regular counters are 36" with 24" stools.

but even if it wasnt standard, the contractor ought to have followed the plans, thats why plans are made, and if he had a reason why it couldnt go as planned it should have been discussed with you.

if you are eating full meals you probably want a 15" overhang, you can get away with 12" if you arent pulling up all the way and just having a drink and snack. but this should be in the plans as well.

yes, ninigret is correct, he was contracted to build what is on the drawings. He needs to lower the height of the wall.

44" is way too high. I don't even think you could find bar stools that high. I will say that the trend now is to make everything at counter height of 36" so you have more counter space. A lot of folks aren't comfortable on a very tall bar stool. If you like the taller counter top, then definitely have him correct it.
