White House Tells Pelosi: Your Fake Impeachment Subpoenas Have No Real Legal Authority


The White House sent an eight-page letter to House Speaker Nancy Pelosi, D-Calif., and other top House Democrats Tuesday saying the Trump administration will not cooperate with Democrats’ impeachment inquiry into the president related to Ukraine.

In the letter, authored by White House counsel Pat Cipollone, the Trump administration says Pelosi and other House Democrats are “seeking to overturn the results of the 2016 election.”

“You have denied the President the right to cross-examine witnesses, to call witnesses, to receive transcripts of testimony, to have access to evidence, to have counsel present, and many other basic rights guaranteed to all Americans,” Cipollone writes. “You have conducted your proceedings in secret. You have violated civil liberties and the separation of powers by threatening Executive Branch officials, claiming you will seek to punish those who exercise fundamental constitutional rights and prerogatives. All of this violates the Constitution, the rule of law, and every past precedent” (emphasis original).

“You have designed and implemented your inquiry in a manner that violates fundamental fairness and constitutionally mandated due process,” Cipollone wrote. “Your highly partisan and unconstitutional effort threatens grave and lasting damage to our democratic institutions, to our system of free elections, and to the American people.”

The letter comes as Democrats controlling the House of Representatives say they are pursuing an impeachment inquiry opened up by the speaker without bringing a measure forward for a vote. Cipollone did not call on the House to vote on impeachment.

Pelosi announced her endorsement of an impeachment inquiry last month based on an anonymous whistleblower complaint filed against the president for allegedly conspiring with the Ukrainian president to investigate corruption linked to potential Democratic presidential nominee Joe Biden. The released transcript of the July phone call between Trump and his Ukrainian counterpart, however, revealed no conspiracy, and several times contradicted the complaint based on secondhand knowledge.

Democrats are still pushing for the president’s impeachment as public opinion for the inquiry tilts in support of beginning the formal proceedings. A new report this weekend emerged of a second whistleblower complaint filed against Trump based on the same conversation with the Ukrainian president. It claims to have first-hand knowledge of the events detailed in the complaint, although the transcript of the phone call between the two world leaders has already been released.

    The President has done nothing wrong, and the Democrats know it. For purely political reasons, the Democrats have decided their desire to overturn the outcome of the 2016 election allows them to conduct a so-called impeachment inquiry that ignores the fundamental rights guaranteed to every American. These partisan proceedings are an affront to the Constitution—as they are being held behind closed doors and deny the President the right to call witnesses, to cross-examine witnesses, to have access to evidence, and many other basic rights.

    Today, on behalf of President Donald J. Trump, Pat Cipollone, Counsel to the President, sent a letter to Speaker Pelosi and Chairmen Engel, Schiff, and Cummings. The letter demonstrates that the Democrats’ inquiry lacks any legitimate constitutional foundation, any pretense of fairness, and even the most elementary due process protections. Democrats are pursuing purely partisan goals, including influencing the upcoming 2020 election. In the process, they are violating civil liberties and the separation of powers, threatening Executive Branch officials with punishment simply for exercising their constitutional rights and prerogatives. All of this violates the Constitution, the rule of law, and every past precedent. For these reasons, the Executive Branch cannot be expected to, and will not participate in, this exercise of partisan political theater.

    President Trump and his entire Administration will, however, keep fighting for the American people, growing the economy, building prosperity, and protecting America’s interests at home and abroad.

    I expected that we would have a constitutional crisis during Trump's reign -- he forbids the House from carrying out its investigative responsibilities.

    Trump needs to be reminded that he's not a monarch, but a president who much operate within the guidelines of the US Constitution. He is accountable; no man (or woman) is above the law.

    House Repubs are to blame because THEY changed the subpoena rules in 2015. The house Dems now have subpoena power thanks to the party of Trump and they don't need to vote.

    calls the WH letter a political document not a legal one as it is legally vacuous and is merely an attempt to get the House to give up on getting more factual details and pursuing obstruction, which this is.

    The House will now move forward with impeaching on several fronts—-obstruction and the shakedown scheme.

    Trump cannot “call off” an impeachment inquiry or an impeachment because he doesn’t like it or with claims he cannot defend himself. He will get a chance to defend himself when the Senate has an impeachment trial. This is a lawless president who is in it for his own benefit and it will be interesting to see if R’s are willing to go down with the ship.

    Mrskjun, have you thought it through? If trump is impeached that will mean that 2/3 of the senate voted him out of office. That's a lot of repubs on board so would trumpsters back them for kicking their "hero" out of office? No, they'd be disgusted with the repubs. Plus, poor pence would have to make a tough decision to either pardon trump or not, either way pence will lose the election for obvious reasons which should not need explaining.

    63 million voters won't be enough to get Trump reelected. "Trump haters" didn't sit out in 2018 and we're not sitting out in 2020. We are not afraid of the Trump minority and you can't threaten us into dropping the inquiry.

    Support for impeachment is growing. 46% of Independents now support it. As much as Hillary was hated, she lost the Independent vote by one little point. Trump NEEDS Independents. Independents went for the Dem candidates in 2018.

    House Speaker Nancy Pelosi took a big political risk through pursuing impeachment, and so far it’s paid off. A new Washington Post poll released Tuesday morning showed that a majority of Americans support the Democrats’ impeachment inquiry (58 percent) and only 38 percent of those polled believe House Democrats were wrong to pursue the inquiry. This poll goes to show that the Republicans are losing control over the narrative around the impeachment inquiry, especially as its momentum continues and new revelations about the president's behavior and that of the people around him continue to drop.
