I don’t know where you are but in my region this would not be considered to code, every joint like this has to be reinforced with steel because toenails like this are notorious for failing as shown. Was this built when you bought the property? Permits?

It was already here when we bought the property and there were permits. is this fixable without taking everything down?

There are metal brackets (forgot name of them) that will connect the two together. Brackets were used on our patio cover instead of toenails.

Most likely the porch is sinking/settling.

No. A structure gains strength from its whole. Two short rafters do not a building failure make.

Yes. You want a Simpson Strong Tie Adjustable rafter hanger. Those shorties aren't going anywhere after that hanger is installed. Use the recommended fasteners too please.

For the record, toe nailing is second only in strength to rafter/joist hangers. It is end grain nailing, as your picture appears to show, that is weak and prone to pull out failure.
