> Coolock Construction put in an air conditioning return vent that had been left out by an earlier contractor. They were responsive, polite, and did excellent work. They were thoughtful about where to place the return vent so as to give the AC enough air to pull in, and went so far as to recognize, before I did, that the hole in the inside of the drywall should be painted the same color as the wall to eliminate the dark open space you can see through the vent slats. I am using them again for other small jobs I have around my town house in the city.

**Q: Design Error Causes $1300 mistake, Contractor is Asking Me to Pay** *(in Remodeling)*

I am in the middle of a kitchen re-do in Central Jersey. I chose the designer at the urging of my contractor. They have worked together in the past, and the designer works for the building supply chain that sells the cabinets. I did not sign anything with the designer nor pay him anything; he is paid by his company. He takes all the measurements and provides the design plans to the contractor. I bought the cabinets from contractor. As it turns out, there was a mistake in those plans.

There is a peninsula which extends at a right angle from one of the counters. After installation, we realized that the drawers in the peninsula could not open because they were hitting an oven under the counter. Fixing the peninsula was easy: they added a 4 inch spacer and extended it. But the countertop was already installed on the peninsula, and it was now four inches short. Cost to replace: $1300.
My contractor claims he is not at fault because he built the peninsula according to the original specs. I consider the designer to be a subcontractor and therefore any of his mistakes are ultimately the responsibility of the main contractor. My contractor has also asked me to consider fixing the countertop by adding an extra piece and a seam, which would look cheesy in my opinion.

I have offered to pay $300, with the balance to be paid by either of the other 2 parties. I think that’s reasonable because I am not at fault here. Any thoughts?

A: you are more than fair and if he was a good contractor and valued his relationship with you he would get it done at all costs
