His agreement stated that it would take him 10-12 weeks to complete the drawings, however, Mr. Bianchi did not show us the drawings until 01/2022, 32 weeks later (he did not provide digital copies until 02/2023). > > At first we were patient with the pace of the project as Mr. Bianchi became unavailable from a professional capacity during the months of 08/2021 & 09/2021 due to personal reasons, and as we liked the design and schematics that were shown to us in 01/2022, we commissioned him to lead the project. > > From there it took another 15 weeks for Mr. Bianchi and his contractor teams to provide us with a proposal and budget, whereas his agreement states it typically takes 4-8 weeks to occur. It was at this time that we paid him a down payment of 50%, and then we were to pay further installments when hardscaping, pool and landscaping started. > > On 05/2022 our backyard was demoed, and we provided Mr. Bianchi with our HOA bylaws and asked him to submit the designs as soon as possible as our HOA can take several weeks to review submissions. Even with constant reminders Mr. Bianchi did not submit the necessary paperwork until 10/2022 (almost 7 months after our backyard was demoed). My favorite response from Mr. Bianchi in 08/2022 was: "I'm still here doing my piece. I have had a very unproductive month but chipping away at it over the weekend." The HOA approved the drawings in 12/2022. > > In the HOA submission packet that Mr. Bianchi submitted, he stated that the project would be completed on 3/31/2023, at this point we were very ecstatic as we thought the project would finally be finished. However, in 02/2023 when nothing had progressed with the backyard, we confronted him regarding the March finish date, and he stated that the date was simply a "best guess" and that it was done to appease the HOA. > > In 03/2023, Mr. Bianchi demanded that he be paid for the commencement of hardscaping and landscaping, neither of which had yet started. He stated that he was working with the structural engineer and that the shade structure designs would be finished by the end of 03/2023 (the City did not approve the drawings until 10/2023). > > The hardscape portion of the project was completed in 04/2024, and at that time Mr. Bianchi was terminated from the project and the final payment for landscaping was withheld because landscaping had not yet commenced, and we decided not to continue with his services. That same month Mr. Bianchi took us to court to contest the final payment. The Hearing Officer found in our favor due to the many delays that were directly due to Mr. Bianchi and his inability to follow the language in his own agreement. > > I have merely shared facts about our 3-year journey so you can decide for yourself if you would like to employ Bianchi design for your project. **Comment from Bianchi Design:** > Many significant details were omitted in the client's narrative. Their grievances stem from external factors beyond Bianchi’s contractual scope and control. > > Bianchi as Designer, provided concepts for 3rd parties to execute, not General Contracting or Project Management. > > Desert Foothills Landscape (DFL) was hired by the client as Contractor to execute the concept. DFL self-managed the procurement of costing, engineering, permitting, scheduling, and labor, and led communications during the build, while Bianchi provided Design support as the HOA asked for edits, and as DFL implemented the project. > > Bianchi’s fee, defined as a percentage of contractor cost, was reduced to the agreed total fee when the client omitted shrubs and cacti, but retained landscape items of trees, drainpipe, decorative rock, and turf. > > COVID’s impact on the Contractor’s timeline delayed trade availability and permit approvals beyond anyone’s ability to predict or control. The client dismisses this reality, fixating blame on Bianchi & withholding his final $4,000 payment inappropriately. > > Omitted details are revealed below: > > CLAIM 1: "Bianchi was unavailable during 8/21 & 9/21 due to personal reasons." This infers Bianchi prioritized himself over commitments. > > REBUTTAL 1: Bianchi was hospitalized with COVID on 8/14/21, isolated 40 days, spending several weeks in ICU. Fellow patients did not survive. He alone returned home on 11/14 after 90 days. Bianchi communicated and worked from the hospital as health allowed, attempting to remain available, moving projects forward in the middle of an extreme personal crisis. > > CLAIM 2: "The design took 32 weeks until Jan ’22. Drawings delayed until ‘23 after much prodding." > > REBUTTAL 2: Bianchi began recovery, showing his design on 12/30/21. Drawings were sent early January ’22, fulfilling contract 1 of 2. Delays into ‘23 is a false claim. > > CLAIM 3: "It took 15 weeks to provide a proposal & budget, exceeding the 4-8 weeks stated in agreements, but we paid Bianchi’s 50% deposit" (for contract 2 of 2). > > REBUTTAL 3: Multiple revisions involving the client extended the timeline. The client also contracted w/ DFL and paid their deposit directly, thus Bianchi was not in charge of DFL. > > CLAIM 4: "We commissioned Bianchi to lead the project with his contractors." > > REBUTTAL 4: Bianchi’s documents define his role as Designer only. DFL as Contractor led the project. This distinction clarifies the wrongful blame the client attributes to Bianchi for 3rd party delays. > > CLAIM 5: "We asked Bianchi to submit designs ASAP to our HOA." > > REBUTTAL 5: The client contracted Bianchi for HOA submittals 5 months after the design presentation. The sequence —construction documents, then HOA exhibits—was emphasized and documented, requiring 5 months. > > CLAIM 6: "In the HOA submittal form, Bianchi promised a 3/31/23 completion." > > REBUTTAL 6: The 6-month estimate based on pre-covid projects was not a contractual deadline. Once onsite work began, DFL’s construction took 6 months. What could NOT be predicted was DFL’s obstacles in securing qualified subs, engineering, and unusual permit delays. > > CLAIM 7: "Bianchi demanded payment for hardscaping and landscaping, though neither had started." > > REBUTTAL 7: Trees & drainpipes (landscape), concrete coping & firepit (hardscape) were proactively completed in advance of the shade structure while awaiting permits. Bianchi validated the invoice with the client, also reiterating the FINAL payment terms to avoid future conflict. The client then invited Bianchi to pick up a check, signifying consent with no further dissent expressed about EITHER payment. > > CLAIM 8: "We terminated Bianchi and withheld the final payment because landscaping hadn’t commenced." > > REBUTTAL 8: Bianchi, having just completed his final landscape task of grass and decorative rock layout with the contractor, submitted his final bill. This triggered the client’s “termination” of Bianchi, asserting “If Bianchi felt entitled to payment, you’ll need to pursue legal means.” > > CLAIM 9: "Bianchi took us to court. He lost due to delays attributed to him." > > REBUTTAL 9: Small claims court time constraints only allow for cursory reviews. The clerk missed that DFL was contractor and orchestrator of schedules, and disregarded testimonies from industry peers echoing their COVID-era challenges. It is Bianchi’s and the Advisor’s belief that a higher court would have issued a judgement against the client. > > CONCLUSION: Pandemic-related delays frustrated everyone. Empathy was extended to the client from Bianchi and DFL, but despite best efforts, this client was overcome by the construction process (not the design) and could not be won back as the project concluded. > > Bianchi fulfilled the total of his obligations. The client received all services, disingenuously allowing Bianchi to continue working under the pretense that he would receive final payment. We did our first 2D conceptual review in August. Kirk and his team had a number of good ideas. We hired him to do a 3D design which we got about 3 weeks later. A: Hi, the fence is made of 1 inch rebar of a more stout grade that does not bend easily. A temporary tack welded continuous top bar connects the rebar, suspending them into an open trench below that they then fill with concrete. Once secure they remove the top connecting bar, and it looks like the rebar just grows right out of the ground. **Q: Where is the bowl from?** *(in Photo Questions)* Is it custom? A: Hi! My trough that I need to step across is 18” deep. A: Good morning. We used a solid slab of granite 4 inches thick with a bush hammer finish for nonslip That was submerged a quarter inch below water. Attached lighting to the underside of the slab to shine down onto the floor to give the back light glow. A: Glad you like it :-) Start with the pool interior finish and then select a tile that matches. That is my best advice. This pool was Turtlebay pebble sheen, and I picked a “rusted Steel” Tile that had a lot of greenish background tint to it. Which is now discontinued of course!
