The contract language stated that if Exhibit G (Limited Warranty) was attached, the builder would provide a limited warranty according to its terms. > > Despite being listed and checked, Exhibit G was never attached to the contract at signing and was never provided to me. > > During the sales process, I was told that a one-year limited warranty was standard on all new construction homes. However, when a dispute later arose regarding construction defects, the builder took the position that no warranty existed because Exhibit G was not attached. > > The arbitration decision ultimately referenced the absence of the attached document when addressing warranty coverage. > > Regardless of the legal interpretation, I believe this creates unnecessary confusion for consumers. When a contract lists and checks a Limited Warranty as included, a homeowner could reasonably believe that warranty coverage is part of the agreement. > > My advice to anyone considering this builder is: > • Do not assume a warranty exists because it is discussed verbally. > • Do not rely on a checked box in the contract. > • Confirm that every referenced exhibit — especially warranty documents — is physically attached to the agreement before signing. > • Obtain and retain a complete copy of all warranty terms in writing. **★ — Joe Nielsen, May 2025** > Before choosing Elon Homes as our builder, my wife and I consulted with a number of builders since we wanted to create a custom home. Before settling on a final quote, we had numerous up-front discussions regarding designs, custom finishes versus standards, and the overall construction process. > > Our journey started in December 2020. Throughout the process, we experienced disappointment when we discovered errors that were not always fixed. Other occasions, like with our kitchen island cabinets, modifications were made without our permission. The kitchen sink was altered as a result of their redesign, which also altered the cabinet width, leaving our cabinets disassembled and incomplete to this day. Other problems include, to mention a few, painted walls and ceilings that are poorly coated and show through the drywall, pocket doors that have scratches from baseboard trim nails that are too long and scrape the doors when they are opened and closed, and stairwell railings that did not get stained. > > Throughout the process, the relationship between the builder and the customer started to deteriorate until email was the only means of communication. We finally moved into our home in August of 2022.
