Beth Robinson, Broker at Hawaii Life Realty insisted our attorney draw up a "Purchase Contract Amendment" to reflect a purchase price reduction. In the opinion of the attorney and us, we felt this was a simple document that should have been done by Hawaii Life Realty without further need for a lawyer. There was absolutely no need for us to have to spend the money for an attorney.

Thanks for pointing out the high professional standards to which Hawaii Life adheres.

We suggest our clients seek legal advice when we are out of the scope of the duties the law explicitly assigns to real estate agents in a dual agency transaction, as this was. The document itself was simple, but the context was one in which dual agency tied our hands in advising our clients, because it did involved changing a price that had been contractually offered and accepted. By having your attorney involved, we avoiding any potential misrepresentation along with the possibility of unauthorized practice of law.
