Once the contract was signed and deposit made, we immediately began securing materials and equipment so we could meet the very tight construction schedule. One week later, the owners unilaterally terminated the contract. There is high demand at this peak landscaping season for materials, equipment, and crews. Therefore we had to place deposits on equipment, with suppliers and vendors, and with our team of artisans immediately after the contract was signed to ensure the discussed timeline would be met. Many of these deposits are non-refundable to us. All deposits have been returned to this client except those paid to suppliers which were non-refundable to us. In the end, we thought our willingness to refund all but a small portion of the deposit was more than reasonable, given the expenses we incurred after the contract was signed and the amount we are out of pocket as a result, which far exceeds the amount of the deposit we chose to retain.
Our process involves working intimately with the client during the design and construction phases, implementing client suggestions and revising projected costs based on site constraints and client needs/wishes. On this project, the process was no different, and the client was seemingly happy with the final design and requested options for phasing in construction, which we provided. Construction phase costs were discussed multiple times over 2 months, with changes made in consultation with the client before they made the decision to sign the final contract. As we worked closely with these clients for over two months, this incident is unfortunate and surprising. We have an open-door policy with our clients which has worked well over our 12+ years in business. We continue to work closely with clients on their design and construction needs and look forward to each unique individual project.
