Maintenance Man

The maintenance man moved off property last year but continues to work at all of the properties owned by the landlords(Father and 2 sons). Now He's 1099-G independent contractor status (which is a whole different topic about him) So last year when he moved but came back one day to do work he came to my door (when we were getting along) to "show and tell" his new pistol (automatic) in his ankle holster. He was excited that he just bought it and passed ccw class so he can carry it concealed. Then he made the statement to me: "I'm just tired of theses smart mouth punks and can't wait". I went to the owner/landlords with my concerns and was met with we can't control what he does he's 1099. Well today he shows up on property to do weeding in front of my apartment. I watch as he squares of to my window (which have tinting film approved by the landlords) and slowly takes off his outer shirt slowly showing the window that he's carrying a snub nose revolver in a holster on his hip. I'm well aware of what he's trying to do, which is goat me so that he can some how justify immediately using deadly force against me. Now I know the short answer here is MOVE and trust me if we could we would. I'm just venting rather than asking a question. Thanks for letting me vent.

I know your just venting but, I have to put in my 2 cents. I'm a senior woman and would be very afraid, I would call the police station and verify that he can carry it and see what they tell you. Be as nice as you can to this guy, he sounds like a jerk, why broadcast that your carrying a weapon....

His employment status is between him and the landlord. If the maintenance man is does not meet the IRS definition of an independent contractor, the landlord could find himself in trouble with the IRS and subject to substantial penalties for failing to withhold taxes. This kind of stuff is actually pretty common because many individuals and businesses do not understand the law.

If you might want to check with your local law enforcement folks but I would think that you should be able to ask him not to carry in your apartment. I would also imagine that the landlord can very much control what he does, including concealed carry.

I'm not an expert in concealed carry laws but most (all) states have laws that are pretty specific about how a firearm can be displayed and used. A concealed carry permit is not a license to brandish weapon, nor to threaten people. You might want to ask your local law enforcement folks about that too.

The landlord is giving you complete BS with the whole "we can't control him because he's a 1099" line. Of course they can - they just have to say, do not carry the weapon on these premises or your services will be terminated. It's that simple. Additionally, in most states businesses may post a sign stating that weapons - concealed or not - are not allowed on the premises. I am a gun owner but I believe in sensible regulation, and I would not want a repairman being armed in and around my home. It's an unnecessary risk.
