So we have had a nightmare with our builder since about the time framing started.
Luckily we only have a few issues left but our builder is trying to make us pay subs directly which is odd. We have about 25k left in draws and 10k in overages we have to pay out of pocket.
The builders contracted stated that the draws would be broke up into 6 or so even increments, but the bank has paid out many more in smaller increments. His contract states that we will get a certificate of occupancy before the final draw but now he seems to be dragging his heels more and more. Realistically the final draw should be about 50k or so. Subs are not showing up and mandating to be paid before they complete the work.
Is there anything legally I can do to move the project forward?
