Confused, is the backsplash and faucet included?

The description is conflicting.
It states: "Order now and we will include the pictured three-hole faucet and a matching backsplash as a gift!"
But also states: "Also note that the backsplash and faucets are not included in the purchase price and will be shipped with your purchase as a upgrade only. In the event that the backsplash or faucets is received damaged or broken, it will not be refunded for or replaced."
Is it included with purchase and if so, if they are damaged can they be replaced?
