Redfin agent puts clause indicating buyer will pay commission

I found house that I like, in my offer, my agent has put in clause that buyer will pay commission if the seller does not pay. Is this right or common.

No. But, everything is negotiable. Your refin agent just wants to be sure they get paid. It is traditional that the seller pays the commission. But, it is not a legal requirement. If you don't want to pay the commission, don't sign. Call and talk to them about it.

An offer is a contract between the buyer and the seller. There is no place, legally, for an agent to even put in that type of language. This type of language is to be put in the Buyers Agency Agreement. It protects the agent's paycheck in case the buyer decides to purchase a FSBO, and the seller is not willing to pay a commission.

This language is part of the RedFin business model based on my understanding of it. In some parts of the country it's common for all agents to use a Buyers Agency Agreement. In other areas it's not.
