Thank you... and no I didn't repot it. Tried taking pics in a shadier spot but my camera wasn't picking up on the dark colors on the leaves as good. I did notice after posting this that if I look at the bottom of the leaves that the veins are dark also. I have only had it about 2.5 weeks so it's still pretty new to me. I know that before I purchased it they had just given it some plant food, mirical grow for vegetables I believe, and I had completely forgot about picking some up, I've never used it before, so I was wondering if that could be part of the problem. It was used to getting some sort of plant food once a week from what they said and then after it came home to live on my deck it hasn't had any, but I get paid tomorrow so I'll be picking some up then. Any suggestions on what would be the best kind to get?

Also include your geographical area, as zone offers very limited information about your actual climate.

Also: What is the variety of tomato? What size pot do you have it in?

I'm near Salem Oregon... and I'm not really sure what kind of tomato, it's supposed to be a bigger kind of tomato tho and I'm really not sure what size pot it is, I'll have to look

If it's not a dwarf variety and you didn't repot it, it's safe to say that the plant needs a much bigger pot. The average indeterminate plant needs about a 10 gallon pot, and even larger is better.
