designing a pool for sloped back yard with fence

In the design process of installing a 16 x 32 inground vinyl pool. I have attached pics of our patio and the are in which the pool is to be installed
I know we need retaining walls... but the real problem is the fence
We do no want to fence he whole yard for several reasons
Large is on of them
The problem is how to enclose it with out it looking ugly for lack of words
You have to keep I 3 feet from the planter and it has to be 48 inches high
Tying it into the patio is impossible
Any suggestions
