Looks like one of the underwings (Catocala species). I expect someone here will know the species.

It's most likely The Bride underwing, but there are so many of these that look similar, I can't be sure. They're beautiful moths when they flash those underwings!

I actually couldn't get him to eat he refused to eat and when I up there was a silk spun around him and he was enclosed in it. Is he dead?

Not dead - he made his cocoon. You can put him in a container that has some ventilation and see what comes out. You'll need a stick or something he can climb to extend his wings and dry out before he can fly.
