Star jasmine is neither a shrub nor a tree - it is a vining plant if given a support or a sprawling groundcover if not. It was only pulled up and rubber banded to that stake for ease of transport and display by the grower or retailer.

Can you return this plant? I'm afraid that it will only frustrate you with its aggressive, vining habit and need for a very sturdy trellis.

Presumably the card hanging from it also tells what kind of growth to expect and what situations it is suitable for. If it is the same type of card that comes attached to them (and many other trees and shrubs here). As the page linked to above makes clear this is not a dwarf plant that grows very slowly, remains small and narrow.

Elaustin, what you want to do just won't work well with Trachelospermum. If you trim it constantly, and it will be constantly, it won't flower. It's pointless trying to force a vigorous vine into being something it isn't. It can't support itself so it needs a trellis or obelisk to climb. Otherwise it will crawl across the ground. If you look at your plant you will see how much growth it has put on just in this season so far. If you want a short evergreen with scented white flowers there are other options.

It should survive in your climate. I’m on the border of 7b and 8a and have 2 containers of it that made it through our winter.

You don't have to worry about star jasmine surviving the winter here. It is one of the easiest vines for this region. Water it in for the first year, then let it survive on benign neglect. As others have pointed out, star jasmine is a vine, not a tree or shrub. It will need something to climb on. If its current location is inappropriate for a trellis, move it. Finally, if you haven't done so already, give it a thick layer of mulch; mulch is essential for its health during its first summer.
