Are you able to be home when they come to your garden? I'd speak with them personally or bring it up for the next HOA meeting.

I've tried to chase them away, they just get worse, and Ive told the Board members I know. "That's nothing." "These guys are really good." The good news is the dues are going up again, I now pay $2,340/ year for this, the property value they talk about has dropped from over $200,000 to maybe $50,000 if your lucky. Warning HOA, stay away.

Take photos b/a. If this issue represents sizable investment, document what the landscapers did and when they did it. Write the home owner's assn. a letter with documented pics. Tell them that you need the board to remediate this on your behalf, and that the HOA needs to compensate you for your lost plants. They may politely tell you to go away. If you have access to Legal Shield thru your personal or workplace, call them and get advice. They will likely be able to write a letter for you at little or no cost if you are a subscriber to their service. Many times the threat of legal action is what it takes for the HOA to take notice. Remember, most HOA boards are made up of non paid volunteers that have other issues on their plates. I'm not making excuses, this is just the reality. I have served for many years on a board, but frankly, I tired of communal living, because others want to treat the environment the same as if they are in a SFR, which can cause problems. The "wisdom of crowds" is not always what it is cracked up to be when you live in a group setting, as you know. I wish you well in your efforts to deal with this unfortunate situation. DMH, the problems are not costing me money, need a life i guess, the problems are that i have to pay whatever the HOA board wants to exhort this year, and the people they/we hire are not at all conscientious about what they do. Have had a rake taken from my hand and told to go inside, stalked, or just met with general rudeness. You must submit photos, and wait for approval from the board to plant anything, after approved and all is said and done you will be told to remove everything and put it back as it was, and/or fined.
Yorkshire Manor I, Arborvitae pruning instructions, top, cut off all leaves, must look distorted from every angle, make as unsightly as possible, this took place after 5 years of meticulous care by myself due to the complaining of neighbors, had an agreement that the maintenance crew would leave them alone.

In this area townhouses and condos are not the only residences governed by HOA's, most neighborhoods one would want to live in are PUDs. Just need a better attitude, and learn not to look. The association will be doing some cement work, the fees are going up, someone on the board has relatives who need work.

Get involved with the HOA. You might have a lot more sympathy for how difficult it is to manage expectations against budget contraints.
