Looks like it could be Brugmansia suaveolens, or angel's trumpet. Yes it is poisonous. So are a lot of other plants (poinsettia for example). If you want to get rid of it just cut it off and bag the stems and leaves and put in trash.

another common houseplant that is poisonous is dumb cane.. aka Dieffenbachia .. you ought to research all your plants.. knowledge is power ....

i dont understand why there is any issue about how to get rid of it.. open the front door.. and lob it out into the street ... hopefully in front of a large truck ...

i might also note... MIL friend probably had it for years.. and she lived long enough to give it away ... how poisonous can it be ... though of course.. you learn all about it.. and treat it with respect ...

btw .... it doesnt look like it is in prime shape anyway ... you might be better off.. just being done with it ... regardless of the other issue ...

I would like to emphasis there are many plants that are poisonous to eat that we plant around and in our houses. Any plant with berries should be suspected until you research it. Many other plants have poisonous properties. Some plant a little will not hurt you, while a lot will kill you.

Just because a animal is munching down on it does not make it safer for humans.
