kitchen countertop deposit

Hello

I am hoping for some help. In December I placed a 50% deposit on a marble slab/counterop installation. I was waiting for my templating date of Feb 11. I receive a call last week saying that they are not wanting to do the install anymore. When I tried to discussed the concerns they made up some excuses and refuse to budge. I really liked the slab and took months finding it. If I put a 50% deposit , then do I own the slab? I was thinking of finding someone else to install it. They refuse. I am wondering if they are wanting to sell it to someone else. How does it work in this situation? So frustrated.

    You're probably out of luck in getting the slab. They probably already sold it to someone else, and maybe even installed it!


    When do they plan to refund your money? If it is on a credit card, I would expect it to be done with 2 days of your agreeing to the cancellation.


    If you paid by check, I would go pick up their refund to you by check, also within 2 days. There is no excuse for a delay.

    They have not told me when they will refund. I paid by credit card. Would another fabricator install it? The price I paid was for the slab and install together. If they were going to give the slab (if its not already in someone else's kitchen) , it will probably be for a significant price. I have no idea what a slab would cost without the install fee.

    Hi that must be extremely frustrating. Can you share the name of the company so other don't encounter the same type of problem.

    Joanne, you must be very persistent, calling every day if need be. Don't wait for them to tell you. You need a full refund since you got nothing. Don't be patient.

    Jeez, how frustrating. What kind of ”excuses” could they possibly make for reneging on a contract?

    Without knowing more about your job and about their reasons, it is impossible to comment on the reasonableness of them backing out.

    The best people to discuss options with is the company you are dealing with. You likely don't have any other options. I suspect their terms of sale allow them to cancel and thus they are probably not in breach, if they are in breach there are little damages to collect unless you had a time is of the essence clause. In the end, communicate with them.

    @Joanne,

    You need to mourn the loss of the slab, and of the effort in finding it. Get a bottle of wine, a box of chocolate, or a trip to the spa.


    Then it will be time to pick up the phone, and tell the owner that you expect the credit back on your card immediately (or at least by tomorrow).


    If you have already mourned the loss of the slab, then pick up the phone, etc. When you get your refund, celebrate the victory with the wine, chocolate, spa day, or a night out dancing!


    Then you can find a better slab!

    Followup to my original thread. I ended up getting my money back, Certain they sold it for more money to another customer. Ended up finding another slab with another fabricator. Much nicer slab and way better company to deal with. Thanks for everybody's responses!
