Locust wood split rail, can be used no more?

We are continuing to work on our wooded lot in south jersey. We have a split rail fence (estimate of age- 20-25 years) and there are many parts of it which are rotted, broken, some covered with lichen, some cut or worn down unevenly and leaning against other pieces.

The fence co came out and left us note that it was locust wood and ”it can’t be used anymore.”

is locust wood in short supply? is it illegal?

I’m puzzled and old school (no cell phone) estimator doesnt come back for a few weeks.
