I have spoken to the roof manufacturer representative Scott Krug from Fibertite after his inspection of your roof as well as an approved Fibertite roofing applicator he had to accompany him on the inspection, Mr.Paul Reichert. Their findings indicate Thermaseal Roofing an approved Fibertite Applicator did not install the roof in accordance with the manufactures required guidelines. To complicate matters I have been informed by the owner of Thermaseal Roofing that they have or are in the process of going out of business.
The results of my discussion with Paul Reichert indicated the corrective work will cost between $10,000-20,000. He estimated a fee of $95/hour instead of his normal $75/hour due to having unfortunately experienced dealing with you during his inspection.
I have consulted my attorney and have concluded that PB Built can assist you in rectifying this matter and work with you to have the parties responsible reimburse you for these costs or you can handle the matter directly.
I recognize that if you elect to handle the matter directly you will also attempt to make a claim against PB Built. However, please be advised that PB-Built bears no responsibility for this roofing issue for several reasons. As you know, we have a Cost Plus a Fee Agreement, and you specifically ordered that PB Built use a Fibertite roof. PB Built then provided you with several Fibertite-approved applicators and you required PB Built to select the lowest bidder by a considerable margin. Furthermore, due to the highly technical and specialized roof application PB Built also advised you that we should engage a roof consultant to oversee this work and you refused to pay for this additional service. Finally, PB Built also stopped the roofing work at the commencement to deal with the parapet high design deficiency, and once again recommended that you engage a roof consultant to address the issue and you refused to do so. It appears now that this parapet high design deficiency was not properly mitigated by Thermaseal Roofing, resulting in the apparent issue you are now facing. Accordingly, the additional cost for the corrective work is your responsibility and not the responsibility of PB-Built.
Nonetheless, PB Built is willing to work on your behalf for no additional fee to help with your claims against the responsible parties (Thermaseal and Fibertite) however you will have to bear the costs and then hopefully get reimbursed as a result of your claim.
