King Finishers

I have paid King Finishers $2000 deposit on December 20 as required by the company to schedule a date for painting my house. We agreed to schedule the job for January 8, 2025. On January 4, I pinged Ray with King Finishers and was told they have a job going and will not start on my job until January 10. In the morning of January 10, Ray texted again and told me they are behind and need to move the job to January 11 which is on Saturday. I told him that we were not available on Saturday and ask them to move to Monday January 13. On Saturday January 11, I did not feel comfortable with the extended delays and decided to find another painter. I notified Ray on Sunday January 12 at noon that we are canceling the work and want our deposit back. Ray stated he already paid for materials that include paints that cannot be returned. I offered to pay Ray $150 for his trouble and will reimburse him for the nonrefundable paints that he paid for provided he delivered the paints to me. In his text, he stated his cost for the non-refundable paints are $764. I offered to reimburse him a total of $1000 ($764 plus $150 and rest for delivery) provided he refunded the other $1000 back to me plus deliver the paint. Ray stated that he is not going to deliver the nonrefundable paint to me at his cost but at retail costs. I told Ray that I do not need the paint as my other painter also has great discount for paint. I told him if he does not want to deliver the paint to me for reimbursement, he can return $1850 back to me. He then came up with other reasons why he won't return my money.
