Bees? On My Deck Oregano.....Help

Hi all I am not sure what I have that has taken up home in and on my Oregano plant that is on my deck. I need some help identifying whether theses are bees or wasps. So far, they are not aggressive, but they are a nuisance. I was going to spray the plant with a diluted mix of cayenne and Dr. Bronner's. Your help would be welcomed.
