I am sorry it hasn't worked out for you but I have to say you need to shoulder some of the responsibility here. We all know the sun is always going to set in the West... you know better than anyone the particulars of how the setting sun hits your patio...

The salesperson may be willing to work with you to resolve the problem without too much expense but I don't think you're entitled to your money back unless he made a commitment to you that it would do something that it does not (specifically, if he said you'd be shaded in the evenings when you obviously are not).

Whose at fault here largely depends on information that you didn't post. Did the awning company visit your house before you signed a contract with them? Did you specifically tell them it was afternoon/ evening sun you wanted to block? Did you hire them to perform design services or did you just tell them you wanted to buy an awning? If you specifically told them that you wanted to block evening sun and you wanted them to design a solution for you, then they are at fault for not doing so. But, if you just told them you wanted an awning and only discussed style and color with them, then they have no way of knowing what your intent was and the fault would be yours. Probably it's somewhere inbetween though.

Sounds like you needed to go wider if the sun is coming in the side. The pitch can be adjusted on some awnings, but that just helps block sun coming in the front, not the side. Can he make you a drape in the same awning material that you could hang from the arm on that side, use shower curtain hooks to put it up and take it down easily ? Extra weight is a concern as it changes wind load and could bend an arm. Maybe just a telescoping pole added next to the awning with a curtain you draw out when needed ? I have had sunbrella drapes made for clients but installed them on permanent patio covers, not awnings and they are a very heavy fabric. Or perhaps you could buy one of the tilt top umbrellas to add to that side of the patio? To give you an idea look at fim-umbrellas.com, they dont sell to the public but have distributors all over the US and Canada. Pricey but well made and you can buy parts if something breaks. I sell a lot of them comercially here in Vegas. Hope this helps. Barb

With a couple of diaper pins you can hang a light sheet to the side for no out of pocket expense. Cheap and ugly sure beats expensive and ugly
Unfortunately I feel you have absolutely no chance whatsoever of getting an already installed awning removed for full credit.

Our backyard faces southwest (mostly west) and our neighbors just got a retractable awning.

My DH also said it would be useless due to the slant of the sun and the fact that it doesn't even extend over the whole deck.

He was right.

Thanks for your support and suggestions. The awning guy was receptive (sort of) to my concerns and is coming today to have a look. Unless it's cloudy.
