House not built to code

Got a new house built by a local builder and realized after moving that the floor span calculations do not meet the code

Builder used Weyerhauser Southern Yellow Pine (SYP) #1 M-29 premium lumber 2X10(16" OC). The maximum allowable span is 16'-9".

The span length on the house floor is 17' using 2X10. How safe is this?
Can the builder be taken to court over this? What are my options as a new home owner?

WHat is the joist spacing ? if he narrowed the spacing he can increase the span. Did he include the proper mid span bracing(s) ?

So, 3" over the limit?

is this your only complaint? or are there other things that do not meet code?

secondly, when they build homes, throughout the entire process someone from the state inspectors office has to sign off on things like framing, electrical, plumbing, ect...

If you took a mortage out for this home, the bank wouldn't qualify the home if everything didn't meet code.

Nor could you buy Insurance on the home.

You can go down to the city hall where the inspectors office is and get a copy of all inspection records, if you don't have any.

3" over limit is inconsequential.

What kind of flooring is over the over-spanned joists? Your most likely consequence will be bouncy floors. If it's tile, it'll likely crack down the road.
