Dog running around upstairs

My new upstairs neighbors moved in about a month ago and they got a dog maybe two weeks ago. Dogs are allowed here but the type of dog they have is not allowed. It's a pit bull and i know aggressive breeds are not supposed to be here. The dog is quite big and he runs around a few hours a day. I have a 5 month old baby and the loud bumping constantly wakes him up from his naps. I've called the office and the girl told me they do have breed restrictions but since people don't listen, they don't enforce the restrictions. I went to the office and told someone else about they dog, she acted concerned and wrote everything down but still, no change. We talked to the people upstairs and told them we can hear everything and they apologized but it's still the same. I'm getting really annoyed and i don't know what to do now. We have a little less than a year left here and i just wanna scream.

What if you told the management that if they don't live up to their part of the bargain of providing you an apartment that prohibited large dogs, you would not live up to the bargain of paying rent. Maybe you can tape the sounds of the dog running around and play if for the management. Maybe threaten legal action?

Babies adjust to noise. In fact many baby "how to guides" recommend making usual noises when you bring them home from the hospital, so they adjust to it, and can sleep thru normal daily noises.

You probably have more of an issue with the idea of a dog being there than your baby has.

You can ask the apartment complex to enforce the rules, but if they won't then either ignore it or move.

I would put all you allegations in writing so when it goes to court or face with the aurthorities, you have ammo to use in your weapon. Otherwise, it just you word against theirs! You have no bullets otherwise!

I probably do have more of an issue with the dog and it does wake my baby up, but i guess you know my child more than me, right? Thanks everyone else for the advice though.

"white noise" as in a fan running in baby's room , or a radio set between stations, can cancel out external noise, and help baby sleep. This is a stressful situation for mothers - Please try not to see the dog as a threat, your baby is safe.

Are they taking proper care of the dog - taking it out for excercise enough - maybe not if its pacing like a caged animal? A lot of dogs need to run and run hard periodically for their health and happiness. Might be a way of framing the issue when talking to these people. Are they new to dogs? Maybe have some resources / contacts you could pass on to them - doggie daycare, dog parks etc. I dunno... that's assuming they care about the well being of their dog..

If dogs are allowed there, but not pit bulls, you could end up having a golden retriever up their running around, and you would be in the same boat. The breed has nothing to do with the problem you are having. If it is a put bull, you have some leverage, but only if the mgmt is willing to enforce the rules. And they'd have to be able to prove it's a pit bull. Not just a lab mix, Staffordshire terrier, etc.

Either keep complaining to mgmt or pay the early termination fee and move.

I am sorry you are going through this. It is unfortunate but sometimes it really depends on the staff member you speak with. If the employee is unable to assist I would just keep calling back until someone answers who can be of help. Wishing you good luck.
