Sodding over existing grass

Hi,

We bought a new house last year and the builder at the time of closing did not put in a clean water collection system that collects rain water and direct it in to the storm water system. In the spring this year this was noticed so they had to dig a 3 feet trench around the immediate perimeter of the house to lay pipes for the CWC system. They back filled the trend and resoded the area. After 6 months the area which was dug up has sunk by a few inches such that water puddles around the house. We complained and the builder came and put dirt over the existing grass with the plan to then put sod over that. He probably added just enought dirt to cover the old sold by less than an inch. Now my question is, if he puts sod on top of this, will the new sod take root next spring given there is old grass just an inch below? I live in Waterloo Ontario.

Any feedback, especially from an experienced person with direct knowledge would be really helpful.

Thanks.
