Gopher/Squirrel/Ghost? HELP!

I have these random areas that keep just popping up. The soil looks dug up, its incredibly loose and the newly seeded fescue just picks right up, like its no longer attached to the earth. The obvious answer is gopher/mole but I didn't know what you guys think.

Reasons I'm skeptical of gopher - 1) the soil depth right there is very shallow. Its right up against concrete and there just isn't more than a little bit of depth to tunnel. Seems like an illogical spot. Also i've had a gopher/mole before and he dug long tunnels. These aren't long tunnels, just torn up areas.

Other theories:

1) Squirrel burying nuts for winter?

2) I over seeded so much in this area combined with hard soil below it, the new grass couldn't push down so it kinda sprung up with the new topsoil. (I definitely over-over seeded this area)

3) Old timey Civil War ghost looking for his lost buried gold? (It IS southern VA). :)

LASTLY, how would you fix this? Its too late to reseed it. The grass is still alive in the dislodged clumps so I may just try to sog it down so much with water that it settles. I bought Mole repellant pellets with good reviews the other day and i'll put those down as well.
