Do you think having the fire out near house and wood above is ok?

    It is ok to have a gas fire pit under a wood surface or next to a house as long as the unit is UL Listed. Every UL Listed unit will have specific instructions on clearances to combustibles. The unit you see needs 69" to the ceiling and 19" to any side combustible structure.

    I am late, but I think it is okay, as long as there is nothing flammable near it. Maybe put something [inflammable] around it?

    How many feet from house to grass? Is it 12 feet, 14 feet, 16 feet? The pergola is attached to the house?

    It appears to be a gas firelplace, so flame is more predictable and controlled than a wood firepit.
