On the 15th day (as allowed by contract) we received the Post Inspection Agreement document with two issues listed. However, the electronic version we received did not include the purchasers' signatures.

However, when our agent called the other agent to let him know we were agreeable, the buyer's agent said that he'd left the radon mitigation out of the document.

There are a couple of issues here:

1. When the PIA goes out, it signals the end of the inspection period, per contract
2. The inspection results and issues were due yesterday, again, per contract, not today, so any additional request is outside of the inspection period
3. We provided 100% availability to the inspection process--confirmed every appointment request within minutes of receiving it
4. The radon meter was picked up two days before the inspection period ended, so there was time to get the results and include them in the PIA
5. Now that we know there's a radon issue, if this deal were to fall through, we'd need to mitigate

A huge part of me feels like "the realtor screwed up, it's on him to make it up to his buyers". Another part recognizes that if it had been included, we'd have had to deal with it (meaning pay for it).

At this point, we're letting our agent handle it--we're going to follow up on the second issue during business hours and then respond to the PIA. This is more of a jolt than if the radon issue had been included in the initial PIA.

Has anyone had experience with a "post post-inspection" request/demand?
