ALL plant patents have a 20 year lifespan.

Anne, realistically US Plant Patents apply to the US, not Canada. Patents are for 20 years from the date of application. North of the 49th parallel we have Plant Breeders' Rights and at present there are 17 varieties listed.

Pieter, Thanks for this information. One of my acquaintances was chastised last year for selling a patented Hosta last year, so I thought I would get it clear in my own mind about the topic. ( I know. . No comments about my fuzzy mind please! )

So I went on the website for PBR and of the 17 listed, only 4 have been granted, the rest were either revoked or abandoned! Any comments on my findings?

Anne, 'Autumn Frost', 'Coast to Coast', 'El Nino', 'Empress Wu', 'Hudson Bay', 'June Fever' and 'Wheee!' all show a Grant of Rights Termination date. The other 10 indeed have either been abandoned or revoked. The 7 listed above have corresponding US Patents.
