From what I understand, in the United States, a plant patent lasts 20 years. You can look up the patent date on the variety you are interested in and see when it was patented.

You can feel free to have fun with your rose seeds, even if the parent plant is under patent.

"Generally, a plant patent can only be infringed when a plant has been asexually reproduced from the actual plant protected by the plant patent". The Nolo article also mentions that the Plant Variety Protection Act of 1970 can protect seeds, but when you read PVPO requirements for application, you see that the seed propagated plant must be "new, distinct, uniform and stable". This would not apply to rose seeds, because each seed produces a different plant from the parent. Also, in order to apply for the certificate, the breeder would need to provide 3,000 seeds of each parent needed to reproduce the variety for examination.

What about Monsanto who was patenting all the veggies and trying to sue farmer's who reused their own seeds and even trying to sue farmers whose crops were wind pollinated by their plants Lol..

Seriously doubt rose people would go that far but who knows.
