"Twisted" Laundry w/ HE Top Loaders

My GE washer says it's "HE" but it also has a full size agitator (wouldn't have a washer without it). I keep reading about HE top loaders and twisted clothes. Is this strictly HE top loaders with the impeller? And if an impeller makes a top load machine HE, how is a top load machine with an agitator HE?
