Kitchenaid fridge too cold

Hi all, I have a concern about our 2-year-old KA counter-depth french door fridge. The top shelf of the fridge, and the back of the fridge overall, are too cold. The front of the bottom shelf stays at 40, but a thermometer placed on the top shelf reads about 33. I have to be very careful about what I put where, and the rest of my family isn't so good with that, plus it's a particular pain with a counter-depth fridge, as it's not like there is a ton of room. Does anyone know if this is a problem with KAs?

I was trying to see where the vents are to make sure they are not blocked, and while I am still not sure about that, I noticed something odd. There is styrofoam in between the fruit/veg drawer housings and the back of the fridge. Is that supposed to be there? We had the fridge installed by the appliance store, and we are generally very happy with them, but I wonder if they were supposed to remove this?
