Class action lawsuit settlements

last year

I occasionally get notices of class action lawsuits of which I might be able to join as a member. Sometimes I fill out the info, sometimes I ignore if I know I won't have documentation, etc. Most recently was the Phillips Cpap recall, where I finally got a payment after lots of wrangling with them.

Then I get a notice about a settlement in a case against VW (I have no memory of ever filling out paperwork) that they have settled it, and I will be getting a check or they can direct deposit. The problem is, I haven't had a VW for many years and the notice of settlement came in my husband's name, not mine. My husband died in 1995! We had a 1991 Jetta that I sold sometime after he died, but I don't recall when, although I bought a BMW in 2003, so that's probably when I sold the VW.

The settlement was small for me $22, lol, but it was obvious it was going to come in my husband's name even though the car's title was in both our names and switched to mine alone after he died. What to do? I knew I couldn't cash a check in his name, though I wouldnt have been above just signing his name and risking it. But I decided, after making sure the correspondence was legit, to try for a direct deposit, guessing the bank's computers wouldn't catch the wrong name on the check. Today, I got notice that it had been deposited! Hopefully, no problems will arise. Now to figure out how to spend my windfall!

I had to do this with a check made out to my father several years after his estate account had closed. I took to my bank, along with my letter of testamentary, and they allowed me to deposit.

My brother had been taking care of paying mothers bills before her death, rather haphazardly I came to learn. He did all online and kept no records at all. How I struggled as executor of her estate.

But I came to realize she'd never received two of the Covid era economic impact checks. It didn't matter to us her heirs, but I knew she would never have let them slip by uncollected and my conscience wouldn't let me just let them go. I did get the checks eventually. I no longer had a joint bank account with her - I'd found her bank exceptionally difficult to deal with as my atty had warned me it would be and closed her accounts by then. My bank wouldn't deposit them to my account to split with my brother and my sister as they were made out to her, but what they did agree to do as a long time customer was CASH them. They then accepted the cash as a deposit and I had the money in form where I could divide it (with paper trail) as she had asked in her will. I think you can credit that to living in a smaller community where everyone knows everyone 😊

Class action suits enrich the ambulance chasing lawyers, not the class plaintiffs.

The other day $220 was deposited to my Venmo for some class action lawsuit; I can’t even remember what it was for. But I’ll take it!

Very, VERY, surprised that anyone would give their bank account info out under these circumstances.

Angelaid, there was no more info given out than what someone would get off of a check when I write one.

We, or rather my mother’s estate, is due a little money from that realtor case. But it ws so hard to deposit a larger check that had earlier been made out to her from something else, and to deal with the sale of the property, that we decided it wasn’t worth it to participate. It really wasn’t going to be much.

I did, however appreciate my share of a Facebook class action.

@Olychick The VW surprise payout - my guess is a search of DMV databases for make & model owners gave VW their list of who to pay. Maybe your payout was split with the person you sold to - prorated? That Phillips recall - was that a direct deposit or check? After reading your post I looked online for status & all I found is payouts start in 2025. I found another # to call but of course it’s after hours east coast. I have a verified claim & I also returned the replacement machine bc we’d already replaced it out of pocket before the replacement machine received. There was no timeline for replacements & we didn’t want to wait & keep using a potentially hazardous machine until replacement received. Phillips sent a prepaid return label for replacement just as they did for their potentially defective machine. Part of our payout is supposed to be reimbursement for out of pocket expense for the replacement in addition to whatever the standard payout is.

Car makers are required to maintain ownership files, at least for first owners, for federally mandated recalls.

I received two different checks from Phillips. I didn’t actually return my machine because I’d spent $$ on a battery pack set up for during power outages and I doubted the new machine would work with it and I didn’t want ti have to figure out a whole new set up. After using the old one for so many years, I figured a few days a year wasn’t going to kill me.

Olychick - My understanding is the machine isn’t a problem unless using one of those ozone cleaner machines - they might cause breakdown of the sound insulation inside the Cpap & if it breaks down it might be inhaled via the hose. Phillips has / had a countersuit against the maker of those cleaners. So, you’re likely pretty safe. I don’t use that & also don’t have sleep apnea. My issue is C02 retention & Bipap is the only treatment so I didn’t want to mess around with it even though I don’t use an ozone cleaner. But, my question really was about when you received your checks - recently or awhile ago. I’m more interested in getting some of my $1200 out of pocket $$ back for the replacement I bought & wondered if I need to start following up. The first one was fully covered by insurance but of course they wouldn’t be interested in paying for my replacement under the circumstances.

You usually do not have to fill out paperwork to be in a class action suit. You usually have to fill out paperwork to be Excluded from a class action suit.

Phillips sent my brother a check for $225. They sent me a debit card for $175. Unfortunately it doesn't work and the Settlement people (based here in Philadelphia) claim there's nothing they can do about it. When I asked if I could come in to exchange it they offered to escalate my complaint. That was 6 months ago. I contacted Phillips corporate and they referred me to the Settlement agents. Just going around in circles........

However I did receive a really nice amount from the class action lawsuit against De Beers. I had to submit detailed appraisals and receipts and I was pleasantly surprised when the check arrived a year later.

@palimpsest Yes, I understand & agree with you. The claim I had to file was for reimbursement of my out of pocket $ since I replaced my machine before Phillips sent me a replacement. They couldn’t give a replacement timeline so some did what I did. For claim you had to document that you replaced before they did.

@KW PNW Z8 The first check I got was pretty early on and was small but I don't remember exactly. The second check was in September. I have Kaiser and they replaced the machine immediately when the recall started. I think I probably had to pay some kind of copay or deductible because the machine was 5 years old and probably due for replacement anyway. I didn't get any reimbursement for all of the accessories I'd purchased. I HATE washing the hoses so every time I'm eligible for new hoses and filters and water chambers I send for them and pay my copay so I have a large stash of all those extras. That way, I can have one day of washing 15 hoses and then have several months' worth of clean hoses and lots of spare water chambers.

@Olychick - 3 phone calls & a bunch of sites later all I learned is that I’m in their data base in ’pending’ status. Payouts being processed by a third party which is the last person I spoke with. Seemingly they’re working through a queue. 🙄

Some class action suits do pay. My brother was awarded 1.3 million dollars. After all the lawyers were paid, he received $751,000. It was from the DuPont C 8 class action suit.

@maire_cate maybe try filing a complaint with your state's Department of Consumer Protection. My DH did that after a year-long battle with Comcast. The state of CT replied within hours and gave Comcast until Dec 25 to resolve it; it was resolved in 24 hours. We were flabbergasted at the ease and efficiency on the part of the state of CT.

Not positive if this type of thing would be their jurisdiction, but worth a try. Or elliott.org

Well, so far my $22 is still in my account, lol!

Mtn - that's a great suggestion. The amount isn't all that much but I am really miffed at the way they have just ignored it.
