Is it a stain or a sealer or an epoxy? More info on exact product and pictures will be helpful also. Stain will not scratch or chip off, this sounds more like a topical sealer or an epoxy finish (which is also defined as a topical sealer).

Yes there was but not sure of the kind.

It is probably the sealer that you are seeing as chipping off/scratching. How long was it left to cure before you or workers started walking on it. Try to find out the specifics on the sealer, and ask your contractor about the options for repair. With some sealers you can reapply more to the damaged areas and they will "self heal" as in the new sealer coat will meld into the existing sealer to give you an almost invisible repair.
