Dagnab it, I started dumpster diving for mowers in '93

It is being discussed on the Tractor forum. Think I'm gonna move south and become a civil lawyer, this is nuts.

The basis of the suit seems to be that the stated horsepower rating on the machine and owners manuals was false. Well duh !! America must be the most litigious country in the world. Can you imagine the money spent persuing these frivolous law suits ?

It sounds frivolous but consumers will benefit in the long run if specs are quoted based on standards rather than on marketing and data manipulation.

I love the ads for 10hp 110v electric shredders :).

Remember one thing---i have been told, if you join a class action law suit, and your case loses, guess who has to pay the winners and court costs!?!

It sounds frivolous, Yep, very! and rusty I hope the loosers have to pay, thats the way it should be, and if the lawyer looses he gets no pay. That would cut down 95% of lawsuits. But, who make the laws? Lawyers and they make them to make money reguardless of the outcome either by their client after they milked him dry or the taxpayer.

I am conveniced that someone can come on your property shoot themselfs and suit you for their actions, or they get drunk pass out run into a tree 100 yards off the road and suit you for it. That's how crazy the law is in the USA.

The gist of the class action was that the manufacturers horsepower ratings were over stated, hence why you just see a torque rating now. Checks have been coming in every day now, although the settlement was significantly less than initially advertised, $10.19 for a push mower, and $21.84 for tractors. I also received a sh!tload of extended warranties for Kohler CV series engines, I wonder if I can simply get a box full of head gasket and bolt kits instead?
