Since I don't know how big your garden is going to be, it's hard to give you specific information...but, there are plants that appreciate a little shade in the summer. Broccoli, cabbage, lettuce, spinach, are just a few. There are also some herbs, like mints (which might be better in pots) that like some shade. Tomatoes, peppers, beans, corn, squash, all like full sun.

I'm hardly an expert, but for the most part (not always) spring/fall vegetables can take a little shade, where as summer vegetables usually like full sun. They're also called cool season and warm season vegetables :)

That's good to take the direction of the sun into account. You may wind up with a shadowed area. So, maybe plan to plant that area with things like lettuce that like a bit of coolness in summer.

You could also put in a shorter fence with matching lattice. If you're really handy, you could make the side panel that connects to your taller fence angle downward or curve to the lower level.
