Tahota, Your second question is the easier of the two. The breeder and introducer of the Tiarella knew it would spread itself. You would only encounter potential liability if you were to sell the pups. Permitting them to spread all over your yard is expected.

As for the first question. Legally and ethically, you shouldn't reproduce the patented plant without permission. Do you know if it was something introduced as a Proven Winner or some other series? Perhaps, that would give you somewhere to contact someone for either permission or sources of more.

Unless you told someone you were doing it or offered them for sale, more than likely you would be the only one to know. Of course, what you choose, only you will know. Kim
