New Galleries Coming!

Hi folks!

Just admiring your gorgeous roses and wanted to let you know about a new gallery that we are going to be launching very soon. This tool is more like a slideshow allowing you to see more then one picture at a time -- and letting others leave comments. The nice thing is that you don't have to have a picture on a host site -- you can upload directly from your computer. And, it's very easy to do.

We have a specfic category just for roses -- and would like to get a few pictures into it before we launch. If anyone would be interested in helping me out, please let me know and I'll help you get started. We're very excited about our new galleries and hope you'll love them just as much.

Best,

Tamara Amey

Tamara, sounds interesting....going beyond whatever is in your policy, please tell me this straight. Some of us have very good images of roses AND put in lots of time tweaking the images in various ways, or sorting through them to find the best, etc. etc. I have not had the time to really read the policy, but I have chosen to link rather than embed my images, when I put them up because I just was not sure of the policy.

Can you just assure me and/or show me the language that my images are mine and not the property of gw? Can you do that? I ask this in purely an inquisitive way, as text is funny to interpret. Thanks very much.

No, it's a very good question -- and I do understand where you are coming from. Pictures that you upload to our site belong to you -- and they always will. Our terms of service states that if you do upload them, we can 'use' the picture -- which simply means that we might feature it on the site or it could be used in an article. But, once again, you will always own the picture. This is a standard that is common on most websites -- it's not exclusive to iVillage.

Let me know if there's anything else I can answer.

Will this be a user friendly way of posting? I have yet tobe able to post a picture on the garden web and I have tried off and on for two years.
Craigs list you just click on post and browse your images from you own computer.

    Hi Daun,

That's exactly how you'll upload pictures to the gallery -- you simply upload it from a folder on your own computer. It's very quick and very easy.

Sounds interesting----I hope I can follow your directions.

    Florence,

I promise -- it's very painless. If you can locate the picture on your computer, you'll be able to load it quickly and easily.

Tamara, thanks for the post and the clarification. There is a still a lot of confusion regarding the GW "Terms of agreement" reg the pictures because of the way it is worded. A lot of expert, experienced, wonderful rosarians have left this site or no longer post pictures because of this. From reading the terms it appears that once the picture is uploaded, the forumer loses all rights to this picture. You state otherwise, that it does not mean so and that the forumer still has the rights to the pics, and that the only way that ivillage will use this is for its own purposes. If you can really clarify this as a general message to all forumers, you will see a lot more pics here and some really great pics on the new feature that you are launching. You need to remove this confusion about the policy before people are willing to directly start uploading pictures to the site...
    Thanks.

    Hi Pappu,

I do understand that any 'legal' document can be confusing -- it can be frustrating. But, I think that the confusion here is the difference between ownership and rights. The TOS has never stated that any content or photographs that you post on GW becomes iVillage property -- it states that they will have use of the content. If you choose to share a picture, that picture will always be your picture -- you will always 'own' it. But, iVillage may choose to use that picture somewhere on our site.
Please understand that this is not just something on iVillage -- most websites that allow member contribution will state the same thing in their terms of service. It's really standard operating procedure.

    I hope this helps!

tamara in your reply to tivoli you state that gw might feature a pic on site or it could be used in an article...please clarify. What sort of article? Do you mean an article on this gw site or do you mean another sort of article(perhaps like in a magazine?)
If you use in a magazine/off site article for which you gain benefit do you pay the original poster? Do you seek the original posters permission?

The truth is, the best photographers will never again freely contribute to the galleries on this site unless the Terms of Service are substantially revised to protect the copyright holders' ownership of photos and to strictly limit iVillage's permitted "uses" of their images.

There are indeed other gardening-related sites that do not claim such sweeping rights to use images in any which way.

The new TOS for photos simply isn't right or fair, and nothing except a new policy that respects intellectual property rights, including how one's photos can be used, will solve the problem.

    Respectfully,
    LIR

This sounds very interesting, and of course, I have nothing that is magazine quality or that anyone would want so that is no problem with me. I know others go to great lengths to ensure great quality. It's about growing roses to me and I enjoy the photographs and regardless of photo quality, it tells me something about the rose I might not otherwise know.

Thanks Patricia for saying it far better than I ever could.
I respect a person's right to protect their pictures but my pictures are just for the love of a rose and wanting to shrae it with other rose lovers.

Frankly, at first when iVillage took over, I deleted all of my pix and went on a rampage, remember Tamora? LOL.

Well, I've since decided that if any of my pix are good enough for someone to want to use, go for it. I haven't a hope in the world of ever selling or using my posted pix in anything but an entertaining way to keep 'Florence' amused.

If I have any really good pix and I become 'delerious' and think I'm going to make some money on a pix, I'll NOT post it. It is roses, not national secrets. :-)

If you are uncomfortable w/TOS, don't post pix. If you are comfortable, or just don't care, like me, post post and post some more.

If we can post from our own computer, does that mean that it is not necessary to reduce the size of the image? That has been my greatest challenge.

    Thank you for doing this.

    Sam, that is beautimous.

Reducing the size of hte image is a curtesy to those trying to view/read the forums. Unless GW automatically resizes images for you that will still be required. However, its not hard. Gimp is a free software tool that can resize images in about 3 clicks for you. AND it will convert them to formats more compatible with web browsing.

However, as other folks have probably already pointed out the TOS will continue to keep many people from posting photos here. However "common" it may supposedly be I can assure you my hosting site does NOT claim the right to "use" any of my images. I sell my images, people who want to use them PAY ME for the right. ;) So I'm afraid I'll continue to not post images here anymore. Sad, but I have to protect myself first.

Thank you, Patricia. It is a found rose, Lundy's Lane Yellow.
I'd have posted another pix, but 'Photobucket' is doing site maintainance.

Half the fun of having roses for me is in the sharing. I give bouquets away all the time. As soon as I learn to put my pictures on the gardenweb I will do that too.
