neighbours tree roots

The neighbors have just cut down a large maple in their front yard near our shared property line. the roots have raised the lawn so that it slopes towards the house. Who is responsible for removing the roots and re-grading the lawn? I feel that since the tree belonged to them, that they should be responsible for fixing the yard but they disagree.
I live in Ontario.

It appears this situation has been going on for some time if it was a mature tree. Did you ever mention the tree root problem with your neighbor before they cut down the tree? It further appears the problem is yours to fix.

I'm not a lawyer, but it would seem to be your problem, especially if you've never discussed it with them in the past, asking them to remedy the situation. However, for your peace of mind, find a local REAL ESTATE attorney and ask his opinion. It won't cost you that much to ask a simple question like that. Be sure to go to a specialist in this field, to get the best, most accurate answer. Good luck.

Jojo, if you don't want to pay for an attorney, contact the Ontario office that handles property. Here, it is called the zoning office.
