Stormwater bio-retention planter overflow ponding/erosion

We have a stormwater bio-retention planter (as part of county regulations). It receives water from a downspout and excess water flows through an overflow at the base. The problem we're having is that during even during moderate rains (see below for a photo from a heavy rain), water tends to pool around the overflow (which drains to a nearby mulch bed). A few questions:


(1) Is this the intended operation of a bioretention planter overflow? I assume not, as it should probably flow further to daylight/grass?


(2) Assuming it is not the intended operation, what is the recommended fix? Should I grade around and beyond the overflow to the lawn, and perhaps add river rock across the mulch bed to prevent erosion?
