Advice - should I temper these windows?

We are in the process of choosing windows for our new construction. We are planning on using Marvin ultimate fixed/casements - fixed 40"x 78" on the first floor and operating 40"x 72" on the second floor (in addition to other, smaller windows). Both floors will have an 8' header, so all the windows will be at least 18" above the floor and therefore won't need to be tempered per code. However, "For safety and/or code requirements, Marvin recommends tempered glass in all units with
a frame size height of 71 1/8" or larger and units with a frame size of 25.2 sq. ft. and larger." The Marvin rep said we don't need to use tempered glass in our 71 1/8"+ windows if we meet code. We have approx 30 windows impacted by the recommendation and tempering costs approx $200 more per window, so I'm looking at an additional $6000.

The frame sizes are 21.4 and 19.8 sqft respectively and all will have a muntins (simulated divided lites) to create a 2x3 grid. The muntins will be on both sides of the glass and there will be a ss spacer in between the glass. I mention the muntins because I would think it would help the glass be more stable, even if not officially considered so (although I am not an expert).

I go between thinking on one hand the recommendation is just CYA on Marvin's part when our windows will otherwise meet code without tempering and on the other hand I don't want to be unsafe.
