Live Oak help

We have a Southern Live Oak that was planted last year and about a month ago we noticed it was not getting water due to erosion. I fixed the problem, but the whole top portion of the tree is dead. It has new growth sprouting out on the trunk. Should I cut the dead off of the top now or leave it till there is more new growth?
