Damage during an Installation

I retained an inerior designer for living room window treatments. During the installation, the installer dropped a heavy finial which damaged the wall. The designer brought in a painter to repair the work, but the wall remains visibly damaged, the only way to restore it to original quality is to repaint the entire room. I recently received my invoice for her commission. Is it fair that I pay the entire commission when she and her installer ruined my wall and left my home in worse shape than when they arrived?

My first thought is that the installer should have insurance.

I would, however, send an e-mail (something you can prove you did) and advise her that you are not paying her until you are satisfied. I am assuming she is paying the installer and then billing you? It clearly was not her fault; but, she is still responsible for making it right.

Thank you. I wouldn't have thought of that. I will inquire about insurance on the installers behalf...

Insurance or no insurance, your designer is responsible for the work and damage her installers caused.........however, she is not responsible for the cost of painting your entire living room, that would be considered a "betterment" to your project. At most she would be on the hook for repairing the damage to the wall (i.e. dent, holes, etc., etc.) and painting that wall to match the surrounding walls. Paint can be matched.
