Ongoing disputes with builder

Hey all,

I posted a couple weeks ago about some ongoing issues that I wanted my builder to correct.

They have finished their "fixes", and I still don't believe they are up to par. The most glaring issue is the WRB (tyvek) and window/door waterproofing.

My lawyer thinks I should terminate this contract with them, which could be difficult. I need to substantiate my claims that they have installed these items against code. The local building inspector approved all of this.

Here's some photos of the WRB and flashing, all of which looks VERY poorly done to me. What do you all think??

Thanks Mark,

I paid for this to be done by code. Any amount of money spent on a new build should get you properly installed products. Am I right or wrong on that?

Where in the applicable code does it detail how these materials should be installed?

What does your contract say about how materials will be installed?

What does your local building code say about window installation? IME things can be pretty vague here - and code does not equal manufacturer's specifications, so that becomes another sticking point. the fact that this continues to pass inspection from your local housing authority isn't going to help your case.

Shouldn't your attorney possibly have people that can help you with this?

What he is getting at is for whatever reason, this may be the best that this contractor is capable of. You have already found out the developer ran him off for whatever reason. While code is great, it is the bare minimum and as you have already experienced, building inspectors are not always know as the most through people. And coide has absolutely nothing to do with manufacturers installation instructions, so I would look more at those as that will effect whether or not the products are warrantied. Or at the very least perform as they should.

The 2015 IRC, which has been adopted by my county, specifies that windows and doors must be installed to the manufacturers specifications. This is true of many building products, which leaves little grey area.

My contract specifies that the home must be built according to the local codes.

Visit your lawyer. Call the window manufactuer’s Rep. Then spit or get off the pot.

Manufacturer's instructions and standards of the trade. Doesn't appear to be either.

This is a doozy, maybe speaking to the developer would help.. other than that it might just be the what this builder provides as far as quality.
