New construction builder problem

I signed a purchase agreement in April for a home to be completed in May. It was approx 95% complete when purchased. Each month builder has sent ”update” saying it will be delayed and ready the following month. It is now October and I visited site and measured that the garage is a foot too small for miminum parking spot size.

Two car garage has one spot 17’ deep and the other spot 14’ deep. The minimum is to provide one standard spot 18’ and one compact 15’. Two compact cars would not fit inside the two car garage because of this.

The builder has no response when I inquire but also they have been having problems getting the Certificate of Occupancy.

They have not given any info about if they plan to adjust thr garage size by extending frame or garage door and I am wondering if the home will ever be complete.

Why would the builder delay fixing this or even commenting on it?

    Wow, what does the agreement say about timeline to complete? Something doesn't seem right with this and could be a red flag. I'd be looking at my options to end agreement and look elsewhere.

    He's trying to get rid of you so he can sell the house for more.

    Well. Follow the MONEY. Where is yours? How much skin in the game have you ? Where's your attorney?

    The garage? Nothing will change. A compact and sub compact will fit...or it's a single garage with storage. He's not going to change the garage, and you can bet the ranch on it. It won't keep him from getting a c of o either.

    Get with your attorney, get your money, and look for a different home.......with a real garage.

    It does not meet the standard for even one parking spot size and it also is not the correct dimention as layed out in the permit approved construction plan. I know this because I have spoken with the engineer who approved the plan. The home is in Los Angeles. Will a city inspector authorize c of o with a building not meeting city requirements by detering from approved plans?


    I know the builder is most likely trying to get rid of me to sell it for more but I have missed out on too many opportunities by being strung along each month since signing the agreement and putting down a large deposit. Lawyer has advised to enforce defect litigation after close of escrow. It is quite frustrating, I wish the builder would just be more transparant and honest about what is going on. I have been living in life purgatory temp housing while waiting since May.

    Wishing, waiting, wondering have proven useless. Go in person with the attorney. Go to the municipality involved and confirm if garage deviation is holding up c of o. Otherwise....it is wishing and more WAITING.

    You signed in April, and finally visited in October only to realize the garage was too small? If the house was 95% complete when you signed the offer surely the framing was done and you were only waiting on the inside trim? Why didn't you look at the garage then before signing?


    Unless the city says it has to be redone the garage will not change, and right now everyone is so busy it will not be a priority. Get a lawyer, like everyone says, find out exactly what is holding up the deal and move forward based on what you find out. Are you willing to accept a garage you can't park in? I understand housing is hard in L.A., but I would start looking for something else just so you have a plan when/if this deal falls through. And move to a new place, even if you have to sign a 1-year lease, surely you can sublet if its in a good area.
